El presente trabajo aborda la noción de seres sintientes, integrada al sistema jurídico por la Corte Constitucional sin un sustento filosófico o epistémico claro. El objetivo general fue analizar el panorama ontológico del ser sintiente como categorización especial para los animales dentro del régimen jurídico de las cosas en Colombia, el cual fue desarrollado mediante una metodología cualitativa con énfasis hermenéutico. Se comprende que la noción de ser, desde sus distintas acepciones, no es un debate netamente teórico, ya que la (...) precisa consolidación de este concepto determina un rumbo para el pensar jurídico, decisivo en el camino a reconocer la calidad de sujetos de derechos a los animales no humanos, dada su capacidad de sintiencia, pues su protección actualmente está condicionada a la moral humana, además, deriva de considerar a los animales parte del ambiente y no individuos cuasi racionales independientes, impidiendo profundizar en posibilidades normativas de protección a éstos. Del análisis, se concluye que el reconocimiento como seres sintientes es un primer paso en las garantías a favor de los animales; el siguiente sería transitar del Estado social de derecho a un Estado socioambiental de derecho, donde se reconozca al ambiente como eje central para definir los parámetros del bienestar humano y animal, teniendo en cuenta una igualdad entre especies, aunada a la responsabilidad de cuidado que conlleva la racionalidad humana. This article addresses the feeling of strangeness about the perception of time that many people with ordinary lifestyles experienced during the quarantine imposed to fight the presence of COVID-19. It describes different aspects of psychological time affected by the interruption of a normal routine and suggests some cognitive mechanisms, attention, and memory that might have been at play, leading to perceive time as being more or less long. The article also describes the critical role of anxiety and temporal uncertainty and (...) how they may affect the functioning of an internal clock and reminds the reader that there are individual differences in time-related aspects of the personality that contribute to the variety of impressions about duration experienced during the quarantine. This work documents the ethical dilemmas faced by anthropologists and researchers in general when investigating Amerindian communities.

Loss aversion can occur in riskless and risky choices. We present novel evidence on both in a non-student sample (660 randomly selected customers of a car manufacturer). We measure loss aversion in riskless choice in endowment effect experiments within and between subjects and find similar levels of average loss aversion in both. The subjects of the within study also participate in a simple lottery choice task which arguably measures loss aversion in risky choices. We find substantial heterogeneity in both measures (...) of loss aversion. Loss aversion in riskless choice and loss aversion in risky choice are strongly positively correlated, but on average riskless loss aversion is higher than risky loss aversion. We find that in both choice tasks, loss aversion increases in age, income, and wealth, and decreases in education. Our results provide novel supportive input to the debate about the reality of loss aversion. (shrink)

By examining an exemplar sample of mental health nursing educational policies and related legislation, in this article, we trace the discursive production of madness as an “othered” identity category. We engage in a critical discourse analysis of mental health nursing education in Canada, drawing on provincial and federal policies and legislation as the main sources of data. Theoretically framed by critical posthumanism and mad studies, this article outlines how the mad subjectivity becomes decontextualized out of its identity‐based understanding and recontextualized (...) as an inferior category of “the human,” circulating within discourses of pedagogy, economics, law, and psychiatry. The article maps the intertextual nexus of the discourse of mental health nursing education, making visible the complex, the arbitrary, and the sometimes‐contradictory nature of the discipline's grappling with identity‐based mental health concepts. We close with several implications for nursing policy, education, and practice. (shrink)

An original study of the philosophical problems associated with inductive reasoning. Like most of the main questions in epistemology, the classical problem of induction arises from doubts about a mode of inference used to justify some of our most familiar and pervasive beliefs. The experience of each individual is limited and fragmentary, yet the scope of our beliefs is much wider; and it is the relation between belief and experience, in particular the belief that the future will in some respects (...) resemble the past and the unobserved the observed, which forms the subject of this book. Dr Blackburn's first aim is to state the problem of induction properly, to show that there does exist a genuine problem immune to the solutions in vogue at present, yet no tin principle insoluble. He gives an extended and original account of the concept of a reason and goes on to discuss prediction. In the end Dr Blackburn produces a rationale for belief in certain short-term predictions based on his reinterpretation of the classical principle of indifference. He claims that a justification for induction can be found along the lines he has suggested and must indeed be found there if anywhere. (shrink)

The book explores the prospects for this project and, in doing so, discusses such fascinating issues as the nature of quantum states, explanation in quantum theory, and 'quantum non-locality'.

John Cook Wilson is an important predecessor of contemporary knowledge first epistemologists: among other parallels, he claimed that knowledge is indefinable. We reconstruct four arguments for this claim discernible in his work, three of which find no clear analogues in contemporary discussions of knowledge first epistemology. We pay special attention to Cook Wilson’s view of the relation between knowledge and forms of thinking (like belief). Claims of Cook Wilson’s that support the indefinability of knowledge include: that knowledge, unlike belief, straddles (...) an active/passive divide; that, rather than entailing belief, knowledge excludes belief; and that understanding forms of thinking other than knowledge (such as belief) depends on understanding knowledge. Reflecting on Cook Wilson’s framework highlights underappreciated concerns relevant to any attempt to define knowledge. (shrink)

Herbert McCabe was unique amongst the grammatical thomists in making significant use of the thought of Karl Marx. He engaged, moreover, with two topics in Marx which have generally been avoided by Christian theologians: class struggle and atheism. This paper examines McCabe’s treatment of both themes, and concludes that he effected a compelling incorporation of them into Christian thought. With respect to class struggle, McCabe understands there to be an intrinsic antagonism in capitalist society. He holds that an antagonistic society (...) is antithetical to Christian norms, and concludes (with Marx) that this kind of society ought to be done away with by engaging in the side in the class-struggle – namely the working class – which has the capacity to do away with class society. He situates this view ironically, however, relativising the claims made about socialist society in the light of God’s Kingdom. With respect to atheism, McCabe brings his thomistic doctrine of God into conversation with Marx’s atheism, arguing that what Marx rejects when he rejects ‘God’ is a thing in the world, whereas God is – by thomistic hypothesis – not one more thing in the world. A radical view, therefore, is sustained by a traditional theology. (shrink)

I bring together social ontology and social epistemology by consideringsocial entities (``epistemic unities'') that are constituted by the holdingof epistemic relations between their members. In particular, I focus onthe relation of taking someone as an expert. Among the types of structuresexamined are ones with a single expert and one or more non-experts whomay or may not know of each other's situation; and ones with more thanone expert, including cases in which the relation between the experts ishierarchical and cases in which (...) it is symmetrical. These structures modela variety of social situations which can thus be given a unified treatment.Among the cases I discuss are persons, which I argue are multiple-expertunities of persons at times. Taking a person as a social unity like this offersa clear sense in which some groups can also be person-like. (shrink)

Online exam supervision technologies have recently generated significant controversy and concern. Their use is now booming due to growing demand for online courses and for off-campus assessment options amid COVID-19 lockdowns. Online proctoring technologies purport to effectively oversee students sitting online exams by using artificial intelligence systems supplemented by human invigilators. Such technologies have alarmed some students who see them as a “Big Brother-like” threat to liberty and privacy, and as potentially unfair and discriminatory. However, some universities and educators defend (...) their judicious use. Critical ethical appraisal of online proctoring technologies is overdue. This essay provides one of the first sustained moral philosophical analyses of these technologies, focusing on ethical notions of academic integrity, fairness, non-maleficence, transparency, privacy, autonomy, liberty, and trust. Most of these concepts are prominent in the new field of AI ethics, and all are relevant to education. The essay discusses these ethical issues. It also offers suggestions for educational institutions and educators interested in the technologies about the kinds of inquiries they need to make and the governance and review processes they might need to adopt to justify and remain accountable for using online proctoring technologies. The rapid and contentious rise of proctoring software provides a fruitful ethical case study of how AI is infiltrating all areas of life. The social impacts and moral consequences of this digital technology warrant ongoing scrutiny and study. (shrink)

This study analyses the sensitivity of public goods contributions through the lens of psychological motives. We report the results of a public goods experiment in which subjects were induced with the motives of care and anger through autobiographical recall. Subjects’ preferences, beliefs, and perceptions under each motive are compared with those of subjects experiencing a neutral autobiographical recall control condition. We find, but only for those subjects with the highest comprehension of the game, that care elicits significantly higher contributions than (...) anger, with the control treatment in between. This positive influence of the care motive on unconditional giving is accounted for partly by preferences for giving and partly by beliefs concerning greater contributions by others. Anger also affects attention to own and other’s payoffs and perceptions of the game’s incentive structure. (shrink)

In his works on argumentation, Aristotle develops three main forms: apodeictical, dialectical, and rhetorical argumentation; dialectic is subdivided into several subspecies. The purpose of this paper is to discuss all of the forms described by Aristotle, to examine their differences and to point out their interrelations. This leads to an examination of the differentiating criteria and their applicability in the case of each argumentation form—and in particular to the question regarding the number of criteria that are necessary to describe each (...) form clearly and unambiguously. It is argued that Aristotle’s works on argumentation contain an implicit system of argumentation forms that is based on no more than three criteria. (shrink)

The thesis of the paper is that persons are similar to a kind of group: multiple-expert epistemic unities (MEUs). MEUs are groups in which there are multiple experts on whom other members of the group model their opinion. An example would be a group of children playing Telephone. Any child nearer the source is an 'expert' for any child further away. I argue that, with certain important qualifications, it is both rational and necessary for persons to treat their future selves (...) as experts (i.e. to satisfy Bas Van Fraassen's Principle of Reflection). In this paper I problematize the use of appeals to the common intuitions people have about the morality of our society’s current treatment of animals in order to defend that treatment. I do so by looking at recent findings in the field of cognitive science. First I will examine the role that appeals to common intuition play in philosophical arguments about the moral worth of animals, focusing on the work of Carl Cohen and Richard Posner. After describing the theory of (...) Moral Disengagement—which has been used to explain how people live with themselves when they commit acts that they themselves believe are wrong—I will review the recent empirical research that details the nature of the moral disengagement that accompanies animal treatment. This includes studies that reveal that those who eat animals engage in the following behaviors: They minimize the nature of the harm of killing animals by casting the practice in a positive light; They obscure personal responsibility by blaming others for harms; They minimize the effect of the conduct on the animals by avoiding reference to the animal origins of meat; They derogate vegetarians as a way of avoiding feelings of guilt for their own practices. Perhaps most importantly, a number of empirical studies have shown that people’s intuitions about the moral worth of animals are shaped by their practice of eating animals—and not the other way around. In addition to the studies on moral disengagement, there is another body of research that has attempted to discover what accounts for the individual differences in attitudes people have toward the moral worth of animals. These studies have linked masculinity and traits like Authoritarianism, Social Dominance Orientation and Right Wing Authoritarianism to the tendency to disregard the moral worth of animals. I will briefly summarize this body of research and will then conclude by arguing that this data should cause us to be highly skeptical of the value that the common intuition that people who eat animals have about the moral status of animals may have in helping us understand the actual moral worth of animals. In this paper we argue that the consensus around normative standards for the ethics of research in clinical trials, strongly influenced by the Declaration of Helsinki, is perceived from various quarters as too conservative and potentially restrictive of research that is seen as urgent and necessary. We examine this problem from the perspective of various challengers who argue for alternative approaches to what ought or ought not to be permitted. Key themes within this analysis will examine these claims and argue (...) they have implications for the interests of the research subject, research governance and regulation. Using our work with TREAT-NMD, the neuromuscular clinical trials network, we posit that there is a place for advancing the discourse of moral rights and moral duties in the context of research, especially from the perspective of patients and their families, and for including the politics of patient activism and empowerment. At the same time we remain vigilant to the danger that the therapeutic misconception and other serious vulnerabilities for the patient population in clinical trials, are at risk of being overlooked. Sound symbolism refers to non‐arbitrary mappings between the sounds of words and their meanings and is often studied by pairing auditory pseudowords such as “maluma” and “takete” with rounded and pointed visual shapes, respectively. However, it is unclear what auditory properties of pseudowords contribute to their perception as rounded or pointed. Here, we compared perceptual ratings of the roundedness/pointedness of large sets of pseudowords and shapes to their acoustic and visual properties using a novel application of representational similarity analysis (RSA). (...) Representational dissimilarity matrices (RDMs) of the auditory and visual ratings of roundedness/pointedness were significantly correlated crossmodally. The auditory perceptual RDM correlated significantly with RDMs of spectral tilt, the temporal fast Fourier transform (FFT), and the speech envelope. Conventional correlational analyses showed that ratings of pseudowords transitioned from rounded to pointed as vocal roughness (as measured by the harmonics‐to‐noise ratio, pulse number, fraction of unvoiced frames, mean autocorrelation, shimmer, and jitter) increased. The visual perceptual RDM correlated significantly with RDMs of global indices of visual shape (the simple matching coefficient, image silhouette, image outlines, and Jaccard distance). Crossmodally, the RDMs of the auditory spectral parameters correlated weakly but significantly with those of the global indices of visual shape. Our work establishes the utility of RSA for analysis of large stimulus sets and offers novel insights into the stimulus parameters underlying sound symbolism, showing that sound‐to‐shape mapping is driven by acoustic properties of pseudowords and suggesting audiovisual cross‐modal correspondence as a basis for language users' sensitivity to this type of sound symbolism. This paper explores Pierre Bourdieu’s conception of social science. In particular, it aims to show that the common assumption that Bourdieu remains trapped in a positivist paradigm does not do justice to his multifaceted account of social science. In order to illustrate the complexity of Bourdieu’s conception of social science, this study scrutinises ten epistemological tensions which can be found in his writings on the nature of systematic forms of knowledge production. In view of these epistemological tensions, a more fine-grained (...) picture emerges which demonstrates that Bourdieu compels us to reflect upon the complexity of the various tasks intrinsic to the pursuit of a critical social science. The paper concludes by discussing the limitations and shortcomings of the epistemological presuppositions that underpin Bourdieu’s reflexive sociology. (shrink)

This paper draws on the account of second nature in Aristotle, Dewey and Hegel to examine the way in which norms become embodied. It discusses the implications of this for both the authority of norms and how they can be changed. Using the example of veganism it argues that changing norms requires more than just good reasons. The appreciation of the role of second nature in culture allows us to: firstly, better conceive the difficulty and resistance of individuals to changing (...) norms because of the material resilience of norms, habits and customs in a culture. Secondly, it argues that the effective adoption of a new norm such as veganism or the behavioral change necessary to respond to climate change, requires not just more good reasons but the creation of material pathways in the culture in which those revised norms can be inhabited. The world’s elderly population is growing, and in Chile they represent 16.2% of the total population. In Chile, old age is marked by retirement, with a dramatic decrease in income that brings precariousness. Older adults are economically, socially, and psychologically vulnerable populations. This condition increases their likelihood of disengaging from their usual social environment, facilitating their isolation, sadness, and discomfort. From the perspective of social identity, well-being can be explained by two principles: social groups’ importance for health and people’s psychological (...) identification with those groups. This study analyzes the relationships between belonging to the neighborhood and extra-neighborhood groups and neighborhood social identification with WB. Urban or rural location and gender are measured, and the sample is 1,475 older Chilean adults of both sexes. The results show that the majority are not members of social groups, and the remaining 48% are members of one or two groups or organizations. Only 4.47% belong to three groups or organizations. Those who belong to groups obtain higher scores, emotional–mental WB, and positive emotions than older adults who do not belong to any organization. Urban and rural older adults have the same level of WB. Membership in close social organizations or distant ones causes different WB associations. Membership in neighborhood councils reduces gender differences in self-assessment of health. This result supports the idea that participation in heterogeneous groups with a shared sense of belonging to the neighborhood is associated with higher WB and lower perceived loneliness. Social identification with the neighborhood, rather than belonging to the group, had the most widespread impact on WB and health indicators. The variable social identification with the neighborhood was consistently associated with indicators of hedonic WB. (shrink)

It is not difficult to find both affinities and divergences in the work of Wittgenstein and Brandom but this particular text explores several key issues beyond first impressions and reveals hidden divergences in supposed similarities and occasionally less profound dissimilarities where their philosophies seem to differ radically. Both Wittgenstein and Brandom, while agreeing that representations cannot be taken to be primitive, would not approve of Rorty’s drive to jettison the very idea of representation along with that of truth. Wittgenstein, on (...) the other hand, “is averse to any attempt at general, explanatory, theories of how language works” while “Brandom is much more positive about the possibility of general, systematic and explanatory theories of meaning.” The divergence about the builders of Philosophical Investigations § 2 and their language use is traced back to Wittgenstein’s being essentially a worldly pragmatist, while Brandom's practice is essentially intralinguistic. In the second part, the text takes issue with Brandom's theory of making explicit, and in the final sections, the paper questions the supposed contrast between expressivism and the “motley of language” and takes a look at Brandom's strive for a normative realism that distinguishes him from other expressivists. Much of traditional rabbinic hermeneutics, what I call "midrashic interpretation," appears to be of such a bizarre nature as to require some sort of explanation, or even justification. This essay attempts to provide a philosophical foundation for midrashic interpretation by placing it in the context of the idea (vaguely neo-platonic) that God is only fully realized as the result of a certain process, a process of which midrashic interpretation is an essential part. In the final section I attempt to spell (...) out some connections between the specifically Jewish question of rabbinic hermeneutics and some more general ideas in philosophy and psychoanalysis. Bedside handover is the delivery of the nurse-to-nurse handover at the patient’s bedside. Although increasingly used in nursing, nurses report many barriers for delivering the bedside handover. Among these barriers is the possibility of breaching the patient’s privacy. By referring to this concept, nurses add a legal and ethical dimension to the delivery of the bedside handover, making implementation of the method difficult or even impossible. In this discussion article, the concept of privacy during handovers is being discussed by use (...) of observations, interviews with nurses, and interviews with patients. These findings are combined with international literature from a narrative review on the topic. We provide a practice-oriented answer in which two mutually exclusive possibilities are discussed. If bedside handover does pose problems concerning privacy, this situation is not unique in healthcare and measures can be taken during the bedside handover to safeguard the patient. If bedside handover does not pose problems concerning privacy, privacy is misused by nurses to hide professional uncertainties and/or a reluctance toward patient participation. Therefore, a possible breach of privacy—whether a justified argument or not—is not a reason for not delivering the bedside handover. (shrink)

The fecund growth of open source knowledge goods in the global communicative environment underlines their public good character. Once knowledge goods are disseminated, their cost and price tend towards zero. It is now obvious (as apparent in recent OECD policy documents) that commercial research and trade in intellectual property capture only a small fraction of open source knowledge, which is expanding even more rapidly than global markets. But for policy makers this poses the problem of how to assign stable and (...) defensible value to free floating knowledge goods. Across the world, research universities have been positioned in a networked competition of institutions with globally mobile personnel and converging goals and organizational cultures. In rapid time global university ranking and the associated technologies of publication and citation ordering and counting have proved potent in arranging status, assigning value and shaping behaviours in higher education. We find that public goods are readily annexed to the longer-standing projects of producing university status and sustaining an imperial global geo-politics of knowledge. Here the relation between status production and free open source cultural production is not so much a contradiction as an antinomy. These issues are discussed in the light of the flourishing and fall of the lowland city-states of the Maya in Mesoamerica, a notable example of a status economy and of the interplay between status reproduction and cultural goods, a dynamic only partly nested in economic production. The article reviews the rankings technologies, led by the Shanghai Jiao Tong University research metrics, the global strategies of university executives, changing national policies on universities and research, and the aggregation of these effects in the emerging `arms race' in investment in innovation.
